I – REGISTRATION

a)This “Business” Framework Service Agreement General Terms (hereinafter referred as “Form”), Approval and Information Form constitute an approval and information form that includes the rights and obligations of the Client regarding the service to be provided by iyzico (hereinafter referred to as "iyzico") within the scope of the contractual relationship that will be established between the Client and iyzi Ödeme ve Elektronik Para Hizmetleri A.Ş. (hereinafter referred to as "iyzico") in the context of the commercial relationship to be established between the Parties. With this Form, it is confirmed that information has been provided regarding the conditions of the Payment Services Framework Agreement (hereinafter referred to as the "Agreement") to be concluded between the Parties, the rights and obligations of the Client, and the establishment of the Agreement through remote communication tools specified in this Form. It is required that this Form and the Agreement be read and examined carefully by the Client and that any provisions and matters to be inquired about be communicated to iyzico in writing before the Agreement is signed.

b)The Agreement can be concluded through any means or digital medium that allows the establishment of the Agreement without physical face-to-face interaction, such as email, text message, and the internet.

c)The fact that the Agreement will be concluded through the remote communication tools mentioned above has become definitive with the approval of this Form by the Client.

d)Utilization of iyzico services by the Client is subject to the conditions of the Client's business model, the conformity of the products and services offered for sale, and the application documents to the legislation, iyzico policies, and procedures, provided that identity verification procedures are successfully completed, and the Agreement is concluded with iyzico.

e)Prior to the conclusion of the Agreement and during the term of the Agreement, iyzico is authorized to verify the Client's contact information.

f)The Agreement will come into force and become valid on the date when the Client approves (concludes) the Agreement, following the successful completion of the information and document verification steps submitted by the Client and other identity verification steps.

II - TERMS OF USE

a)The approval and conclusion of the Agreement by the parties will mean that the other terms and conditions mentioned and specified in the Agreement, which are stated to be an integral part of the Agreement and regulate the mutual rights and obligations of the parties as a whole, have also been accepted.

b) iyzico reserves the rights mentioned below:
- Requesting additional information and documents in addition to the information and documents submitted during the application by reaching the Client before the Agreement is concluded; and/or, Rejecting the Client's application for service with a stated reason;
and/or, Not sending or not accepting the offer sent by the Client without stating any reasons.

c)In case of any contradiction between this information text and the provisions of the Agreement, the provisions of the Agreement shall prevail.

III - GENERAL PRINCIPLES RELATING TO SOFTWARE OPERATION

a)iyzico agrees and declares that, following the conclusion of the Agreement, it will allow the Client to use the iyzico software in a non-transferable or licensable manner, limited to payment services, for the acceptance and processing of payments made by end-users for the products and/or services offered for sale through various channels by the Client.

b) The Client acknowledges that iyzico is not a bank, credit or financial institution, and the service is not a banking or credit service; it is solely a payment intermediary service. The Client acknowledges that iyzico only provides payment services and is not a trustee for end-user payments.

c) The Client agrees to pay commissions and/or fixed fees within the scope of the amount specified in the Agreement, or any other fees specified under different names, and taxes to be paid within the scope of legislation for using iyzico services.

d) The Client acknowledges, declares, and undertakes that it is aware that the use of third-party products and systems provided and supplied by third-party solution partners may be required for the use of the iyzico software and that, therefore, the Client is responsible for protecting the use of the iyzico software in accordance with the usage conditions of these third parties' products and systems or iyzico directions, and updating their own systems as necessary.

e) iyzico may provide support during the implementation of the necessary system tools for communication between the iyzico software and the Client's channels. Integration between the channel and iyzico software will be established with the implementation of the necessary system tools.

f) The iyzico software will only be used by the Client on the channels owned by the Client and specified in the Agreement. In case of a change in the subject of activity approved by iyzico, if it is determined that the new activity or content is not reported to iyzico and/or is not compliant with legislation, international card schemes rules, or iyzico policies, iyzico may terminate or suspend the service provided without any notice.

g) iyzico is authorized to provide usage support and instructions regarding how the iyzico software will be installed and applied in the Client's channels. In case the instructions are not followed by the Client, the Client acknowledges, declares, and undertakes that iyzico will not be responsible for any damages that may be incurred in this regard. The instructions can only be changed by iyzico. Changes made by iyzico can be notified to the Client seven (7) days in advance.

h) iyzico will make reasonable efforts to equip and strengthen the iyzico software with the necessary security certificate to prevent unauthorized access to information by unauthorized persons.

i) The Client will provide effective and necessary security standards regarding the data processed in their channels for transactions made by end-users through the iyzico software. The Client is responsible for protecting their own channels and servers from virus attacks or third-party attacks with systems provided by third parties with appropriate experience and expertise. The Client will immediately notify iyzico of any suspicion or occurrence of an attack or data breach in their own channels or the iyzico software. iyzico will provide effective and necessary security standards for its own system. iyzico will conduct efforts to protect its own systems and/or servers from virus attacks and third-party attacks with systems provided by third parties with appropriate experience and expertise.

j) iyzico reserves the right to change the security standard as a result of changes in security standards made by other payment service providers, system partners, or other third parties.

k) The Client is obliged to notify iyzico of any changes that may occur in the partnership structure, field of activity, address, or other contact information within 7 (seven) days at the latest. In case of incompleteness of the information or failure to notify changes in a timely manner, iyzico may terminate the Agreement with the Client at its discretion without compensation and without the need for notice, or may temporarily suspend the service. In addition, in this case, iyzico will not have any liability for damages that may be incurred as a result of the actions taken by iyzico regarding the information that has not been updated by the Client.

IV - MANAGEMENT INTERFACE AND iyzico BUSINESS MOBILE APPLICATION

a) The Client can access the management interface through a web browser and the business mobile application on mobile devices in order to use iyzico services and make necessary updates and technical settings. To access iyzico services through a web interface, the internet browser must be at least Chrome 90 or higher, Safari 12 or higher, Firefox 100 or higher, Edge 100 or higher, or Opera 90 or higher. The mobile device must have a minimum operating system of Android 7 and iOS 13.

b) In order to access the management interface, the Client will create a password in compliance with iyzico's password policy, and this password will be used to log in to the management interface.

c) The Client is responsible for keeping the password confidential, not disclosing it to unauthorized individuals, and preventing its use for purposes other than its intended purpose. iyzico is not responsible for any damages incurred by the Client as a result of losing the password, not safeguarding it properly, or it being exposed, unless it can be proven that the fault lies with iyzico.

ç) The Client's preference for using the 3D Secure or equivalent method in payment transactions related to the payment service provided by iyzico is entirely at their discretion, unless otherwise determined by iyzico. The Client can use this discretion to enable or disable the feature for using 3D Secure or an equivalent method through the management interface. However, the Client acknowledges and agrees that they are solely responsible for the use of this discretionary authority and any consequences that may arise from its use or non-use, and they will hold iyzico harmless in this regard.

V – CLIENT'S RIGHTS AND OBLIGATIONS

a) The Client is not allowed to make changes to iyzico system tools, interfere with system conditions beyond those specified by the system, or act contrary to the installation and usage instructions of system tools. The Client accepts, declares, and undertakes that they are solely, unconditionally, financially, and flatly responsible for any damages that may arise due to this matter.

b) The Client may publish an informative text regarding the use of iyzico payment services to end-users on their own platform. The Client will be solely responsible for any incorrect and/or incomplete information in this informative text and any damages that may arise due to such incorrect/incomplete information.

c) The Client is obligated to provide the following information to end-users on their own platform:

  1. Name/Surname or trade name, MERSIS number (name and surname, tax identification number, and headquarters address for artisans and craftsmen),
  2. KEP (Registered Electronic Mail) address, email address, phone number, and, if applicable, the business name and registered trademark,
  3. Information about the professional chamber to which they belong, ethical rules related to the profession, and how to access them electronically,
  4. Detailed descriptions of the products and services offered through the platform,
  5. Product return and payment return policy,
  6. The headquarters address specified in the Commercial Registry to which the Client is registered,
  7. Accepted currency for payments,
  8. Existing restrictions on sales or legal restrictions (e.g., minimum age, etc.),
  9. Delivery terms and conditions,
  10. Privacy policy and information about the processing of personal data,
  11. Transaction security methods provided by the Client.

d) The Client is obligated to provide information to iyzico before, during, or after the service about the products or services offered on their platform. If the Client fails to provide this information as required by this clause and fails to provide information upon request, iyzico reserves the right to refuse payment for products or services for which information has not been provided, restrict the Client's access to iyzico services, and withhold payment for products or services for which information has not been provided. In addition, the Client acknowledges, declares, and undertakes that they are solely, unconditionally, financially, and flatly responsible for any damages that may arise due to this matter.

e) The Client acknowledges and agrees that they will track payment transactions carried out through iyzico through the management interface or mobile application, and they will be solely responsible for any damages that may arise from not tracking the transactions through the management interface.

f) The Client will not offer products or services on their platform that are illegal or not permitted for sale online. If iyzico determines that products or services that are illegal, contrary to iyzico's principles, or specifically listed (and not limited to) in the following list are being offered on the Client's platform, iyzico reserves the right to refuse payment for such products or services or to completely suspend the use of iyzico software:

  1. Pornographic products or services of an erotic nature,
  2. Products that contain or promote child pornography or indicate signs of the distribution of pornography,
  3. Products, services, or applications related to the spread of drugs and psychotropic substances or poisons,
  4. Sale of prescription drugs or medical devices prohibited from online sale,
  5. Products or services that facilitate or promote activities that may lead to the violation of intellectual and industrial property rights through technical means,
  6. Products and services within the scope of terrorism legislation,
  7. Products or services containing insults or derogatory content that may damage iyzico's reputation in any way,
  8. Illegal gambling and betting,
  9. Making payments regardless of the location and type of gambling debts or gambling winnings,
  10. Establishing a pyramid sales system and any suspicion of the establishment of a pyramid sales system,
  11. Products that violate the intellectual and industrial property rights of third parties.

g) Rejection of a payment transaction or complete suspension of access to iyzico software due to the reasons mentioned above does not constitute a violation of the Agreement by iyzico. iyzico is not responsible for any of the damages that may arise from these reasons. The Client will hold iyzico harmless from all claims in this regard.

h) If iyzico incurs any damage due to the Client's activities related to products and services offered on their platform, which are illegal, contrary to regulations, the Agreement, this Form, or international card schemes rules, the Client is obliged to fully compensate iyzico for all damages upon the first request. The Client is also obliged to continuously monitor whether the products and services offered on their platform are among those listed in this clause or are prohibited by laws or regulations and to prevent the display or sale of illegal products and services on their platform.

i) The Client will fulfill their tax obligations for each product and/or service sold on their platform.

j) The Client is aware that payment transactions on their platform may occur without the consent or authorization of end-users. In such a case, the Client agrees, declares, and undertakes to cooperate fully with iyzico to prevent such payment transactions before they occur or to fulfill legal obligations if they occur.

k) In the event of a suspicion that a payment transaction carried out on the platform is fraudulent, related to money laundering, or for the purpose of laundering criminal proceeds, iyzico will immediately fulfill its legal and contractual responsibilities and, to the extent permitted by law, inform the Client about the matter. iyzico's rights of blocking, offset, pledge, or setoff arising from the Agreement regarding such a transaction are reserved.

l) By signing this Agreement, the Client acknowledges, declares, and undertakes that they agree to share their information (TIN, TR ID, Business Code, etc.) with public institutions and organizations or payment system operators and System Partners for the purpose of meeting legal requirements, facilitating the processing of payments, preventing fraud and malicious use activities in the payment field, and providing the service within the scope of the Agreement, and/or to be given a unique business code specific to this information, in accordance with the legislation, which is a legal obligation within the scope of the law, and that the information provided by them to iyzico is correct and has been obtained through legal means.

m) In cases where the Client fails to fulfill their responsibility in accordance with the above article, iyzico is aware that a business code cannot be obtained and services within the scope of the Agreement may not be provided, and the Client acknowledges, declares, and undertakes that they will not claim any compensation from iyzico for this reason.

VI - RIGHTS AND OBLIGATIONS OF iyzico

Right of iyzico to Reject Payment and Block Access to iyzico Software or Management Interface/Mobile Application:

a) iyzico shall have the right to reject the processing of payments made to the Client and/or refund payment amounts to the end-user's payment service provider without transferring them to the Client, especially in the following cases (but not limited to such cases):

  1. If there is a suspicion that the transaction is not compliant with regulations, rules, or international card schemes rules,
  2. If there is a suspicion that the transaction was made without the knowledge of the payment instrument holder used in the transaction,
  3. If there is a suspicion that the transaction is not a genuine transaction (except for tests).

b) iyzico shall have the right to block access to iyzico software or the management interface/mobile application, especially in the following cases (but not limited to such cases):

  1. If there is a computer virus threat to iyzico's software from the Client's platform,
  2. If the information specified in the Agreement and this Form is not available on the platform,
  3. If it is understood that illegal products or services are offered on the platform and illegal content is also present in the Client's platform,
  4. If the products or services offered on the platform and the content of the platform do not comply with the principles or obligations specified in the Agreement or this Form.

c) In the event that iyzico software is unilaterally and completely shut down by iyzico for any reason, the Agreement and this Form will be terminated, and any receivables that may arise until the date of termination and/or for transactions that occur until the date of termination will be collected by the Client, subject to iyzico's other rights. Within the scope of this article, iyzico's rights of recourse, blocking, offset, pledge, or setoff arising from the Agreement are reserved.

Maintenance of iyzico Software, Interruptions, and Fault Resolution:

a) iyzico will provide continuous maintenance and hardware necessary for the normal operation of its software. In this regard, iyzico reserves the right to temporarily stop or restrict the operation of its relevant servers.

b) iyzico will make every effort to ensure that interruptions are carried out, especially on non-working days, in the evening or at night (between 19:00 and 06:00). However, in case of emergencies, interruptions may also occur outside of these hours.

c) iyzico will inform the Client in advance about interruptions, except in emergency situations, by sending an email message.

d) iyzico does not guarantee uninterrupted access to the management interface and mobile application or the uninterrupted operation of iyzico software. iyzico will make efforts to ensure that payments are processed on time, but it is not responsible for delays in these transactions due to problems arising from third parties, such as other payment service providers and system partners, and not caused by iyzico. iyzico is not responsible for any damages that may arise from these situations. The Client will hold iyzico harmless from all claims in this regard.

VII – PROTECTION OF PERSONAL DATA

a) The Client accepts, declares, and undertakes that their personal data may be processed as described in iyzico's Privacy & Personal Data Policy, which is published in its most up-to-date version, for the purpose of providing iyzico services or fulfilling legal obligations.

b) The Client, as the data controller, is responsible for making a contract and/or obtaining the necessary approvals, informing the end-users about the sharing of their personal data for the purpose of providing iyzico services or fulfilling legal obligations as stated in the Privacy & Personal Data Policy mentioned above, ensuring that the data is accurate and up to date, and ensuring that there are no special categories of personal data among the data. The Client will not hold iyzico liable for any disputes and/or damages arising from the failure to enter into this Agreement, obtain approval, or fulfill the obligation to inform, and if a request is made by a third party in this regard, the Client will indemnify iyzico.

VIII - COMPLAINT PROCEDURE

Müşteri, iyzico tarafından sağlanan hizmetlere ilişkin şikâyet taleplerini aşağıda belirtilen şekillerde iletebilecektir:
Yetkili çalışana iyzico’nun resmi internet sitesinde yer alan iletişim telefon numarasından ulaşarak veya [email protected] adresine e-posta göndererek veya iyzico’nun resmi internet sitesinde yer alan yazışma adresine iadeli taahhütlü posta göndererek.

Müşteri tarafından yöneltilecek şikâyetler asgari şu ayrıntıları içermelidir:

Şikâyet nedeni, işlemlere ilişkin tanımlayıcı numaralar, işlemde dahil edilen tarafların ve sorunun ayrıntılı bir listesi ve olası hata mesajlarının içeriği.

Müşteri bir şikâyet ilettiğinde iyzico’nun kendisinden talep edeceği iletişim bilgilerini vermekle ve ayrıca iyzico talebine istinaden şikâyete ilişkin belgeleri, bilgileri veya hata mesajlarının içeriği gibi ek bilgi ve belgeleri temin etmekle yükümlü olacaktır. iyzico, şikâyetlerdeki eksiklikler ile bağlantılı olarak meydana gelen gecikmelerden sorumlu olmayacaktır. Müşteri, iyzico yazılımı ve işlemlerle ilgili olarak son kullanıcılar tarafından iletilen şikâyetleri üçüncü kişiler ile paylaşmayacak ve şikâyetin ilk olarak kendisi tarafından çözümlenmesi ile yükümlü olacaktır. Müşteri, kendisinden veya iyzico’dan kaynaklanan sistemsel sorunlarda son kullanıcıları derhal bilgilendirmekle yükümlüdür. Müşteri herhangi bir şikâyet sebebiyle son kullanıcıları doğrudan iyzico çalışanlarına yönlendirmeyecektir. Müşteri ve son kullanıcılar arasında meydana gelen uyuşmazlıklar Müşteri ve son kullanıcılar arasında çözüme ulaştırılacak olup, iyzico bu uyuşmazlıkların tarafı olmayacak ve bu işlemlerden veya uyuşmazlıklardan sorumlu olmayacaktır. Şikâyetler, iyzico tarafından kendisine ulaşma tarihinden itibaren 7 (yedi) gün içerisinde yanıtlanmaya gayret edilecek olup, çözümün herhangi bir üçüncü taraf ile iş birliği gerektirmesi halinde, söz konusu üçüncü taraftan gerekli bilgilerin alınması için bu süre sınırı uzatılabilecektir.

IX - LIABILITY ARISING FROM ERRORS AND DAMAGES

a) iyzico will not participate in the provision or supply of products or services offered for sale on the Client's platform to end-users. Therefore, iyzico shall not be responsible for the lawfulness of the Agreement concluded between the Client and end-users regarding products or services paid through iyzico or the products or services for which such payments have been made.

b) iyzico shall be liable only for direct damages arising from a breach of its obligations under this Form and the Agreement, and it shall not be liable for damages caused without its own fault or by any third party.

c)iyzico shall not be liable for delays in transferring funds to the Client's account due to incorrect or incomplete entry of information related to the payment transaction by the Client, or for delays in completing transactions. iyzico shall not be responsible for delays, the inability to complete payment transactions, errors, and disruptions in payment transactions due to circumstances beyond its control or arising from third parties, except for its own fault. iyzico reserves the right to set off the mentioned amounts from payments to be made to the Client.

X - TERMS OF USE OF THE iyzico LOGO

a) The Client agrees, declares, and undertakes not to use iyzico's name or logo in any advertisements, promotions, or announcements without the written permission of iyzico. The Client will include logos of card organizations (TROY, Visa, Mastercard, etc.) on the payment page. The Client agrees, declares, and undertakes not to make any changes to this area without the written permission of iyzico.

b) iyzico reserves the right to change its software or website content or design at any time, provided that it does not disrupt the service provided to the Client. In such a case, iyzico may make the modified materials available to the Client. Afterward, the Client will update the logo or other materials permitted for use by iyzico.

c) The Client acknowledges that iyzico may publish the Client's e-commerce name or logo as a reference on iyzico's official website. For this purpose, the Client will provide the necessary information, especially in HTML format or another format requested by iyzico, including the logo, upon request by iyzico.

XI - GENERAL PRINCIPLES REGARDING PAYMENT TRANSACTIONS

a) iyzico services can be used to process payments made during the purchase of products or services offered on the Client's platform. Any use other than this purpose that violates laws, card organization rules, and iyzico's Agreement and policies will result in iyzico unilaterally and immediately suspending the service. In this regard, iyzico has an unconditional and indefinite right to claim compensation.

b) In order to enable payment transactions through iyzico, the Client must include iyzico's provided payment methods on the payment page of their platform or use the payment page provided by iyzico.

c) After the end-user makes a payment to the Client using iyzico for the purchase of a product or service, the payment service provider who issued the payment instrument used in the transaction must approve this transaction. If the mentioned payment service provider approves the transaction, the status of the transaction will be marked as "successful." If the payment transaction does not occur for any reason, an error code or error description, if available, will be added to the transaction's description section. A successful transaction can be refunded upon request through the management interface. However, the ability to refund depends on whether the Client's payment account at iyzico has sufficient funds to cover the refund amount. The Client can make a deposit to their payment account if necessary. iyzico will not be responsible for any damages resulting from the inability to process a refund due to insufficient funds in the payment account.

d) The Client acknowledges, declares, and undertakes that the account number provided for receiving payments belongs to them. Changes to the account number can only be made in writing with the instruction of the authorized person of the Client.

e) If the identity identifier provided by the Client is incorrect, iyzico cannot be held responsible for non-performance or incorrect performance of the Payment Transaction.

XII - MALİ HÜKÜMLER

a)iyzico has the right to collect the commission, transaction fee, fixed fee, or other fees specified in the Agreement, as well as taxes within the scope of legislation, for every payment transaction made through iyzico services. The Client can view the current commission fee rate and transaction fee or various other fee items from the management interface at any time.

b)iyzico has the right to unilaterally change the fees. Notifications of changes will be sent to the Client in accordance with the terms and methods specified in the Agreement.

c)In cases where the Client uses the payment service in foreign currency as permitted by the legislation, currency conversion will be made at the rates published by the bank operating under Law No. 5411 on the relevant payment day. iyzico reserves the right to change the exchange rate to be applied, provided that it is announced on the iyzico website.

XIII - AMENDMENT AND FINAL PROVISIONS

a) The terms and conditions to be announced by iyzico on the website www.iyzico.com, together with this Form, constitute an integral part of the Agreement between the Client and iyzico.

b) iyzico may unilaterally change the Agreement, this Form, or other annexes of the Agreement by providing prior notice. Changes required by laws will enter into force on the same day that they are published in the Official Gazette.

c) The Client will comply with the rules and procedures prepared by iyzico to ensure compliance with laws and rules of card organizations, such as TROY, Visa, MasterCard.

d) The Client acknowledges, declares, and undertakes that even if the Agreement has terminated, the provisions regarding reassignment, set-off, pledge, collateral agreements, compensation for damage resulting from spending objections, and the principles regarding payment transactions will continue to be in effect.

Framework Service Agreement Approval and Information Form

I – Information

This Framework Service Agreement Approval and Information Form ("Form") is an approval and information document that contains the rights and obligations of the User regarding the service to be provided by iyzico Payment and Electronic Money Services Inc. ("iyzico" hereafter) within the scope of the contractual relationship between the User and iyzico. The User is required to carefully read and review this Form and the Agreement and inform iyzico in writing about any provisions or matters that they wish to obtain information about, before signing the Agreement.

II - Agreement

By digitally approving this Form through the system, the User declares that they have been informed about the e-money issuance and payment services offered by iyzico within the scope of the Framework Agreement to be concluded between the Parties and gives their consent to the remote communication conclusion of the Framework Agreement.

III - Services

Payment Services: Within the scope of the Framework Agreement to be concluded with iyzico, the User will benefit from the payment services offered by iyzico. In order for the User to benefit from iyzico's services and to perform payment transactions in this context, it is necessary for the User to use a payment instrument such as a card, a smartphone with internet connectivity, a computer, a password, or similar means. The User's smartphones must have Android 7 and above, IOS 13 and above, and their browsers must have version 90 and above for Chrome, version 12 and above for Safari, version 100 and above for Firefox, version 100 and above for Edge, or version 90 and above for Opera.

Electronic Money Issuance: Electronic money is the monetary value issued by iyzico in Turkish Lira against the funds received from the User, stored electronically, accepted by other real or legal persons apart from iyzico, and used for payment transactions defined in the Law.

When the User requests electronic money issuance by:

a. Using a payment instrument via the iyzico web interface, mobile payment method, bank transfer/EFT through the bank account, purchase credit obtained from affiliated institutions, or

b. Using a payment instrument via the payment page on the online or offline platforms where the merchant sells products and/or services within the scope of Protected Shopping, through bank transfer/ETF through the bank account or purchase credit obtained from affiliated institutions, iyzico will issue Electronic Money to the User for the amount of funds transmitted by the User.

The User may request the conversion of Electronic Money into fund, either partially or entirely, at any time. Unless required by legislation or the policies of affiliated institutions, iyzico will process the refund of the funds corresponding to the Electronic Money upon the User's request by the end of the next business day at the latest.

During the conversion process, the User can only request the refund to their payment accounts or instruments that are under their ownership, as long as there are no security reasons or unless otherwise provided in the legislation. If the User paid for the Electronic Money with a credit card, the refund of the Electronic Money can only be made to the same credit card account. The User cannot withdraw the loaded amounts of Electronic Money with their credit card in cash or transfer it to their or any third party's account.

The refund of the Electronic Money that the User loaded into their iyzico account via the mobile payment method can only be made to the mobile line used by the User during the loading process. The User cannot withdraw the loaded amounts of Electronic Money with their mobile line in cash or transfer it to their or any third party's account.

As a result of the User's request for Electronic Money issuance through the shopping credit, the repayment of the Electronic Money amounts loaded into the iyzico account can only be made to the User's own account opened with the credit institution. The User cannot withdraw the Electronic Money loaded into the iyzico account with the shopping credit in cash or transfer it to any third party’s account.

When making payments to iyzico within the scope of Electronic Money or Payment Service, the User's credit card or bank card information used will be stored in iyzico's system, which complies with PCI-DSS Level 1 security. The User can subsequently use the stored card information to make payments or manage and delete the card information from the management interface or mobile application.

Secure Payment with Bank/Credit Card: The User can benefit from iyzico's secure payment services with the bank/credit cards defined in their iyzico account. After this process, an amount equivalent to the payment amount is deducted from the User's bank/credit card, and Electronic Money is issued in return. The User can use the converted amount of Electronic Money for purchasing the relevant goods and/or services.

The User is aware that if they act on behalf of someone else's account or transfer their registered phone line to a third party, change their SIM card, switch their phone line to another mobile operator, or change their identification, contact, or other identification-related information, they must immediately notify iyzico in writing in accordance with the Law No. 5549.

If the authorization process during product and/or service sales, where payment is authorized by the recipient or initiated through the recipient, does not specify the exact payment amount, and/or if the actual payment amount exceeds the anticipated amount considering the spending history, contract terms, and other relevant factors, the User can request a refund under the condition that the goods/services have not been consumed, the service has not been received, and no refund has been made in a duplicate manner.

The User will be responsible for protecting their iyzico account (including the relevant username and password), the payment instrument they possess, and the shared data. They shall not share them with unauthorized third parties and will take all reasonable and necessary measures to keep them secure. The User is obliged to use the payment instrument only in accordance with the issuance and usage terms. From the moment they receive the payment instrument and/or have the possibility to use and dispose of it, the User is obliged to take all reasonable and necessary security measures. In case of loss, theft, or unauthorized use of the mentioned information and/or payment instrument, the User must immediately inform iyzico by calling iyzico's Call Center at 0216 599 01 00 or by sending an e-mail to [email protected].

Protected Shopping: Within the scope of the Protected Shopping service provided by iyzico, which is a protection program for the entire shopping process, the User, as the buyer and recipient of the payment transaction, in case the product/service purchased for personal use is not delivered within the specified/committed time period, or in case of a claim that the product/service sent by the User does not meet the specified qualifications, or with a valid request in accordance with the Law on the Protection of the Consumer No. 6502 and the Regulation on Distance Contracts, the User shall submit their request and, if applicable, related information and documents to iyzico within 30 (thirty) days from the order date or within 3 (three) days from the delivery date through the secure shopping support page provided in the Protected Shopping e-mail sent by iyzico. The User acknowledges and understands that the Protected Shopping program does not provide any guarantee of rights from iyzico and that it does not replace the rights arising from consumer legislation. The User also declares, accepts, and undertakes that their objections or other claims within the scope of Protected Shopping will not prevent them from exercising their rights under consumer legislation, and therefore, they will not make any claims for damages or compensation from iyzico under any name.

Products/services not covered by Protected Shopping are regulated in the Framework Agreement, and the rights of objection and claim provided by Protected Shopping will not be valid for payment transactions related to these products and services.

Card: Within the scope of the services provided by iyzico, if the User loses or has their physical Card or the designated virtual Card stolen, or if they become aware of any transaction carried out without the User's consent through these Cards, the User accepts, declares, and undertakes that they are obliged to immediately notify iyzico by calling the Call Center at 0216 599 01 00 or by sending an email to [email protected]. In such cases, the User shall be responsible for damages arising from unauthorized use, up to 250 TL (two hundred fifty Turkish Liras), subject to the reservation of the relevant legal liability amount for transactions carried out within 24 (twenty-four) hours prior to the User's notification to iyzico. This limit shall not apply if the unauthorized use is based on the User's gross negligence or intent, or if the necessary notification as detailed above is not made.

Regarding iyzico's Card service; the User's right of withdrawal begins on the date the Contract is established. The User may exercise their right of withdrawal within 14 (fourteen) days from the establishment of the Contract, without stating any reasons and without incurring any penalty. The User must notify iyzico of their intention to exercise the right of withdrawal during this period, either through the Call Center at 0216 599 01 00 or via email to [email protected]. According to the relevant legislation, the Card will be canceled by iyzico within 7 (seven) days. In case it is determined that the Card or Electronic Money account is not used in accordance with iyzico's policies or the relevant legislation, or if there is abuse of campaigns or the card system, iyzico may immediately suspend the use of the Card, Electronic Money, and/or the services it provides.

If iyzico makes changes to the Framework Agreement and service conditions, the User has the right to terminate the Framework Agreement without any charge by submitting a written notification within 30 (thirty) days from the date of learning about the change, following the notification regarding the change and termination right. The User acknowledges, declares, and undertakes that all kinds of notifications will be made through the iyzico Mobile Application, www.iyzico.com, or the notification channels shared with iyzico. If the User does not exercise their termination right regarding the Framework Agreement within 30 (thirty) days from the date of learning about the change, they will be deemed to have accepted the change. If a different period is specified within the scope of the legislation regarding termination conditions related to the change, the period specified within the legislation will be applied. The User will inform iyzico in writing of any changes to their contact information. Otherwise, the notifications made by iyzico to the User's existing contact information will be considered valid.

The Parties may terminate the Framework Agreement at any time without stating any reasons by submitting a written notification at least 1 (one) month in advance. If one of the Parties breaches its contractual obligations and fails to rectify the breach within 1 (one) week despite a written request from the other Party for the rectification of the breach, the Party making the written request may terminate the Framework Agreement immediately and without paying any compensation by sending a written notification.

If not specifically requested in writing by the User, fees, discounts, deductions, transaction fees, account maintenance fees, commissions, loyalty points, and similar breakdowns related to iyzico services will be presented to the User electronically in a separate statement.

IV - Refunds for Incorrect and Unauthorized Transactions

The User may request the correction of unauthorized or incorrect transactions by immediately notifying iyzico within 13 (thirteen) months following the completion of the payment transaction. If iyzico deems the User's request appropriate, the amount of the relevant transaction will be refunded directly to the User without being transferred to the recipient of the payment transaction. If the payment transaction amount has already been transferred to the recipient at the time of notification, iyzico will request a refund from the recipient for the corresponding amount and ensure that the refunded amount is transferred to the User.

V – Reporting and Resolution of Complaints

The User may submit complaints regarding the services provided by iyzico to iyzico, providing their full name and user number associated with the iyzico Account, in the following manner:

Users may submit written applications to iyzico within a maximum of 2 (two) years from the date of the disputed transaction or action, regarding disputes arising from the services provided by iyzico and not falling within the scope of commercial activities (thus having an individual nature). If the application is not responded to within 20 (twenty) days from the application date, or if the response is considered unsatisfactory by the User, the User has the right to apply to the Individual Customer Arbitration Committee of the Turkish Payment and Electronic Money Institutions Association ("TÖDEB") within 60 (sixty) days from the response date, in accordance with the Regulation on the Principles and Procedures Regarding the TÖDEB Individual Customer Arbitration Committee, via the application form available on the website https://todeb.org.tr/hakemheyetibasvuruformu/ . The User retains the right to apply to the Provincial/District Consumer Arbitration Committees for their complaints regarding the services provided by iyzico.

As a conscious internet user, being informed about the following issues and taking necessary precautions will help you utilize all transactions and services on the internet, including those provided by iyzico, more securely:

  • When accessing iyzico's website or being redirected to iyzico for payment during a transaction, the appearance of a padlock symbol in your internet browser's address bar indicates that you can safely use our site.
  • Do not trust links provided in other websites or emails that require you to click on the link. Do not use these links to access information.
  • iyzico never asks for customer passwords, requests personal information, or asks for updates via email.
  • Receipts for transactions can be obtained through the Mobile Application.
  • iyzico never requests your card information via phone, SMS, email, etc.

iyzico delivers special announcements, warnings and similar notifications to the User via Mobile Application notification, SMS or e-mail. The User should not rely on information obtained outside of these channels.

The User acknowledges, declares, and undertakes that this form is an integral and inseparable part of the Framework Agreement, and that it has been notified to them that this form and the Framework Agreement can also be accessed through iyzico's website (www.iyzico.com), and that the contract terms can be reviewed upon request. The User confirms that they have carefully read and understood the Framework Agreement, and accepts that the Framework Agreement will be concluded between the Parties through a distance communication tool, and agrees to its terms.
